New York Poker
Poker players in the state of New York are not in luck when it comes to live poker. The state has declared the game of poker a ‘chance’ game and files the game under their definition of gambling options. The state does offer lotteries that are state run as well as race horse wagering, but all other forms of gambling are non-existent in the state.

Despite the fact that poker is not legal in New York, does not stop the game. New York City is known for illegal poker rooms and police raid these games on a regular basis. Arrests are made in these cases and the laws of the state have stood the test of time as any challenge of this nature towards the game of poker has ever been successful.

Despite all of this, there are a few limited poker options in the state. The Turning Stone, a tribal casino, offers a poker room thanks to the Indian Gaming Regulatory Act.

Online Poker in New York
The state of New York does not currently have any legislation that contends with online poker. Because the constitution prohibits most forms of gambling, it would be quite difficult for the state to begin to allow poker options via online operators. The online gambling prohibition would have to be eliminated first before poker could be brought into the picture.

However, legislation may soon be changing in the state. In 2013, a movement has started with certain legislators who are trying to legalize internet poker in the state as they understand the revenue benefits of this option. The movement has just started so it may be some time before any option is available in the state.
